Obamacare Rollout Disasters Continue *Open Thread*


The fallout from the Obamacare rollout continues to be in the news as the implementation of this law has been fraught with problems. Never mind the massive cost for a website that still has major issues, a realization that has finally dawned on Secretary Sebellius (more on that below), or the millions of Americans who have lost policies and doctors they have chosen and wanted. One of the other major issues with this website is the lack of security when it comes to people’s personal information.

But wait – it isn’t just that there are major issues with security. As it turns out, those brain trusts who put this thing together are breaking the LAW. No, really, they are. From the Daily Caller:

The bureaucracy tasked with Obamacare implementation may be violating a law that requires government agencies to keep private information safe.

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).

But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end­-to­-end testing.

Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.

Can you believe this crap?? Are there NO competent people associated with this massive policy that is affecting every single one of us in one way or another? There sure doesn’t seem to be.

In case you are wondering, the requirement for this assessment is pretty clear:

[…] A CMS Information Security bulletin released in April 2013 explains that FISMA applies to

…all organizations (sources) which have physical or electronic access to a Federal agency’s computer systems, networks, or IT infrastructure; or use information systems to generate, store, process, or exchange data with a Federal agency, or on behalf of a Federal agency, regardless of whether the data resides on a Federal Agency or a Contractor’s information system. This includes services that are either fully or partially provided; including other agency hosted, outsourced, and cloud computing solutions. (Pg.1)

Part of FISMA’s law requires CMS to complete the ATO process.

The implementation of a Federal Government information system requires a formal Government Authorization to Operate (ATO) for infrastructure systems and/or all application systems developed, hosted and/or maintained on behalf of CMS. (Pg. 8)

Another CMS document entitled “Security Information Review” released in September 2012 reaffirms the FISMA requirement:

By law, each CMS FISMA system must obtain an ATO before it can be placed into operation. Therefore, security controls must be operational, effective, managed, and continuously monitored. (Pg. 7)

CMS has published guidelines called the “Authorization to Operate Package Guide” to provide instruction on how to obtain an ATO. Each ATO package must include 12 “artifacts” in order to be submitted for authorization. The table of 12 artifacts includes two known as the “Security Control Assessment Plan (SCA Test Plan)” and “Security Control Assessment Report (SCA Report).” […] (Click here to read the rest of this disturbing, yet informative, article.)

How, HOW, do these people still keep their jobs?! It is simply mind boggling.

Chief among those who should lose their jobs is Secretary Kathleen Sebellius. As I noted above, her much belated acknowledgement that there might just be a little problem with the website during Wednesday’s hearing was just head-smacking in its minimization. From the Charlotte Observer:

[…] Health and Human Services Secretary Kathleen Sebelius has asked her department’s inspector general, Daniel Levinson, to review the contracting and project management problems that led to the bungled rollout of the HealthCare.gov website.

The move is one of three new initiatives Sebelius announced Wednesday morning in a blog post and during testimony before the health subcommittee of the House Energy and Commerce Committee. […] (Click here to read the rest.)

Uh huh. As a friend pointed out at Facebook, how nice that she is going to have her own department investigate itself. THAT’S a great idea. Ahem. And despite the cheery headline of that Observer article, “With website working, Sebelius’ Capitol Hill hot seat cools down a little,” things are not as awesome as Sebellius and Obama would like us to believe. It was that point Rep. Pitts tried to get Sebellius to answer:

Right. More, “we don’t know,” but one thing people SHOULD know is that until you shell out money, you are NOT covered. Just to be clear here. And that is if you are willing to put your personal information out there for any Tom, Dick, or Harry to hack into courtesy of your government’s failure to follow the law. But hey – if you’re feeling lucky, go for it!

Ugh. The sheer incompetence of these people who STILL HAVE JOBS continues to amaze me. What is worse, WE are paying their salaries! I think we can agree that if this happened anywhere else other than Government service, these people would be drawing Unemployment about now.

    Here’s another cute thing, if I say so myself 🙂 A big buck just now came into our front yard (we like to set out deer corn and water for them).
    I excitedly told our 3-yr. old grandson to quickly come look at the deer, which was about 20 ft. from our window. The grandson took one look and said “We gotta take him to the hospital…he’s got sticks on his head!!” He’d never seen a buck before….I thought that was so cute.

      ROTFLMAO – ohmygosh, Cuz, I do not know how in the world you STAND it! That is hysterical!!! 😀 Love it!

      We put out food and water for the deer here, too. Last night, we were in the hot tub for some much-needed knee relief. There was some lovely moonglow by which we were able to watch the deer come into the yard to eat. They are just so lovely to watch, aren’t they?

      That buck story is so freakin’ funny. I swear – y’all must be mighty healthy in that household since laughter is the best medicine! 😀

          And it was amazing watchign them last night. I just love watching the deer. We have had as many as 13 at one time in the yard. And every day, when we see them, we race to the window saying,”DEER!” as if they didn’t come every single day. Love watching the little fawns, too. So, so cute!

    I just read this on Drudge: In a letter sent late Wednesday, Chairman of the House Oversight Committee Darrell Issa reminded Health and Human Services Secretary Kathleen Sebelius that obstructing a congressional investigation is a crime.

    As I read that I thought to myself that it might be a crime but she isn’t ever going to be punished for her incompetence or criminal behavior. None of the people responsible for this mess will have to suffer any repercussions from this. The problem with government is that there is never any accountability…ever.

    That monkey is the cutest thing…hehehehe.

      That does seem to be the problem, doesn’t it? These people continue to thumb their noses at the law, and continue unabated. No, check that – they often get PROMOTIONS. I just do not remember a time when the White House was able to run roughshod over the laws and Constitution of this country with the Congress either powerless or unwilling to do anything abt it.

          SSDD, for years, we had a couple of rescued greyhounds. When we lived up in the mountains of Virginia, they had to wear booties when it snowed. It was pretty funny, I must admit, thought they did get used to them pretty quickly.

    I admit that I sometimes have a hard time getting past things, so I’m still stuck on the Mandela memorial and Obama’s inappropriate behavior. I saw a photo late yesterday afternoon of his kissing Michelle’s hand, as if that would make up for his unacceptable behavior. I looked at that picture and thought to myself – Why is that any more acceptable than taking a selfie and flirting with the Dane? This was supposed to be a ceremony to honor the death of a leader of a country.

    Hillary is 44 had a funny line saying the deaf people of South Africa were actually lucky that the sign language interpreter was a fake because then they didn’t have to be subject to the swill Barry was offering.

      LOL abt the deaf people being spared. That is one way to look at it. After seeing more on this today, I was struck anew by how close this man was able to get to world leaders. How in the HELL does that happen?!

      Wasn’t that weird abt the hand-kissing? It just seemed like an odd thing to do, almost subservient by the looks of it. I could be totally projecting, but I don’t think so. There was a whole lot wrong with that whole situation, so I don’t blame you for being stuck on that event.

      Isn’t that something? And that they use CAPS to make sure the people know not to rely on it?

      I simply d not understand why CGI wasn’t fired, forced to return all of our money, and have the 3 twenty-somethings design this thing. For heaven’s sake, it’s not like it was rocket science. Much of the system has already been designed and is in use by abt a gazillion companies.

      Once again, this is precisely why the Government has no business in our health business…

    I just got a letter from my insurance company (Blue of California). They have approved a ONE DAY stay for a total knee arthroplasty. They said any more would have to be approved by a “Medical Management” team. Awesome. Welcome to the world of Obamacare!

      I am glad he is coming out now and making this clear, but it begs the question: what took him so long?????? Seriously! What in the hell TOOK so long? it is Year FIVE of Obama’s reign, and this began on DAY ONE of his presidency in 2009. Great that we are told NOW that these shots are propaganda, but why in the HELL did he wait until AFTER Obama was re-elected??

      Makes his upset ring a bit hollow, I have to say.

      I hear you – it is a mess, and scary indeed. It is amazing how this law is so dragging down this country.

      And then Obama has the audacity to demand that if Reps are upset abt it, they should make suggestions – as if they didn’t make a TON of suggestions before, during, and after the bill-now-law was in the works…

    Reading all that administrative “law” garbage gives me a headache, and does nothing worthwhile to help society.

    One of the reasons I believe in limited government is because I believe in natural law. I want to be able to live my life the way I should without having to read a million words about ATO or FISMA or security plans or anything else. The 10 commandments does it for me.

    The biggest problem with the federal government controlling lives is that integrity is then not up to the individual, but up to some administrative regs dreamed up by a bunch of hired help. (When I learned some parents in our judicial district are required to take parenting classes from a prostitute who has been hired by the State, I was flabbergasted.) Integrity can only flow from individuals.
