The Plot Thickens: CIA vs. Senate Intelligence Committee *Open Thread* *UPDATED*


Update at the bottom of the post.

In my most recent post, “Bellweather, CIA-ing Touble, and C-BS Loses (And So Do We),” I raised the issue between the Senate Intelligence Committee and the CIA. Well, things have heated up just a bit since I wrote that. Whooey, getting hot in here!

This morning, The Hill had this headline: “White House knew CIA was reporting Senate staff to Justice Department.” That, in and of itself, is a loaded claim to make. Here is more of the story from The Hill:

The White House knew the CIA was filing a report with the Justice Department that suggested Senate staffers had committed a crime by taking documents from a CIA computer.

White House spokesman Jay Carney on Wednesday said the CIA gave the White House a “heads up” it would file the report, which Sen. Dianne Feinstein (D-Calif.) said was an effort to intimidate congressional investigators.

The White House was told about the referral by the CIA director and general counsel, Carney said. He said the White House did not weigh in on the matter.


“The president has been aware in general about the protocols and the discussions and occasional disputes about the protocols involved in the provision of an unprecedented number of documents from CIA to the committee,” Carney said. […]

As noted above, the issue at hand has to do with the alleged removal of documents from a CIA computer:

[…] The CIA has charged that Senate staffers improperly gained access to an internal document reviewing agency interrogation practices, although it is unclear how they gained access to the file. Feinstein has suggested a whistleblower may have placed the document on the server, or that it was accidentally included in documents turned over by the agency. That’s EXACTLY what I was wondering. Just how in the WORLD could Senate Staffers have gotten access to a CIA document, or to a CIA computer? The latter is much harder to fathom for me. I imagine a document may have accidentally made its way into other documents, or intentionally if it was a whistleblower kind of thing. But to get into a computer? Hmmm. That’s harder for me to see happening.

Senator Dianne Feinstein (D-CA) is none too pleased with her committee being blamed while she is claiming that the CIA is hacking into the Committee computers, a matter that would be a clear Constitutional violation. From The Hill, “CIA’s Brennan faces uphill fight in taking on Sen. Dianne Feinstein”:

Feinstein on Tuesday expressed frustration with reports in the media that ostensibly came from the intelligence community. Throughout her speech on the Senate floor, she went through a number of assertions in news articles about the actions of her staff that she claimed were false.

The California Democrat alleged CIA officials spied on the work Senate staffers assembled on network drive that was supposed to be segregated from the CIA’s networks. She also accused CIA officials of removing documents from the computer network Senate staff used at a CIA-provided facility. One of the documents removed was “Internal Panetta Review,” which she says corroborated the Intelligence Committee’s findings.

Sen. Mark Begich (D-Alaska) said he would like to see reforms including a new mandate on the intelligence community to brief Congress more broadly on its activities. The CIA and other agencies make most of their briefings to the Senate and House intelligence panels, which are not allowed to share the information.

“The intelligence committee is a closed group, so what they share in that group is kept in that group. Why the CIA feels they cannot share information or be asked questions or not be forthright is a problem,” said Begich.

Former Sen. Trent Lott (R-Miss.), who served on the Intelligence panel, said Feinstein’s reputation lends weight to her allegations. […] (Click here to read the rest.)

This battle seems far from over. If the CIA is indeed spying on American citizens on American soil, that alone is INCREDIBLY problematic.

Sen. Feinstein also claimed that what the CIA is currently doing with the DOJ is an attempt at intimidation (The Hill):

[…] Feinstein also charged that the referral to the Justice Department — suggesting Senate staff had broken the law — was a bid to intimidate her investigators.

“There is no legitimate reason to allege to the Justice Department that Senate any staff have committed a crime,” Feinstein said. “I view the acting general counsel’s referral as a potential effort to intimidate this staff — and I am not taking it lightly.” (Click here to read the rest.)

Like I said above, WHOOEY. This is going to get a lot hotter I am betting before it is all said and done.

And it raises a larger question, and that is the continuing, increasing, violations of our Constitution. If there is any truth to Sen. Feinstein’s claim at all, that is a HUGE issue. HUGE. I reckon we’ll just have to stay tuned to find out what the results are of the investigation.

UPDATE: The Hill has a good synopsis of what the issues are between the Senate Intelligence Committee and the CIA in this piece, “Five things to know about Feinstein’s blow-up with the CIA.” Feinstein’s charge includes:

[…] Feinstein said Tuesday that CIA officials removed important intelligence documents from what she described as a “stand-alone computer system” with “a network drive segregated from CIA networks” that had been set up for exclusive use by Senate investigators under an agreement with former CIA Director Leon Panetta.


Feinstein said the network was supposed to be restricted to Senate staff and CIA information technology personnel, who were prohibited from sharing information with other CIA personnel.

She says the CIA staff removed more than 900 pages of documentary evidence from the Senate investigators’ segregated network in February and May of 2010 without the approval of the Senate Intelligence Committee.

She says CIA officials also removed from the supposedly secure network an internal CIA document known as the Internal Panetta Review. It’s at the center of the dispute because Feinstein asserts it corroborates the Senate Intelligence Committee’s 6,300-page report. The CIA officially denied, minimized or ignored key sections of the Senate report in its June 27 response.

The CIA countercharge is:

[…] The CIA claims Senate investigators improperly obtained the Internal Panetta Review and illegally transported a printed portion of it to a secure space in the Hart Senate Office Building.

Shortly after the Jan. 15 meeting, Feinstein was informed that Robert Eatinger, the acting general counsel of the CIA filed a criminal report against the Senate investigators with the Department of Justice.

The New York Times cited an unnamed government official in a March 8 report who claimed Senate investigators “had penetrated a firewall inside the CIA computer system that had been set up to separate the committee’s work are from other agency digital files.” […] (Click here to read the rest.)

My local paper, the Post and Courier, also had an editorial on this issue today, “Get to the Senate-CIA truth.” It’s a good piece, and also sums up the issue well, including the Constitutional issues this alleged behavior from the CIA raises.

I don’t understand why the Bros have not sued the crap out of Reid.

          And along THOSE lines, can you believe the SEIU was protesting a HOSPITAL what received $100 MILLION from the Bros?? That says a whole lot abt thsoe folks.

        FYI, I don’t usually watch the panel when Williams is on it because I just can’t stand him. The faces he makes when someone else is making a point are hideous.

          I can’t stand Juan Williams. He is nothing but a parrot for the DNC talking points. He is illogical as all get out, condescending, and arrogant. Hard to believe his SON is pretty high up in the RNC. Hmm, then again, maybe not…

          And to accuse someone like Gowdy of “grandstanding” speaks volumes – abt WILLIAMS.

          There are so many other people they could choose besides Williams. Joe Trippi, Doug Schoen, people like that, would be fine. They are definitely Dems, but they also use their brains.

            I only watched last night because I very much like to listen to George Will. I don’t always agree with him, he’s far more to the right than I am, but his remarks and responses are always well thought out and interesting.

            He doesn’t bother calling names. He says things in such a way that you know who he thinks is an idiot but he says it politely. Civility at all times with a deadly aspects.

            The looks that he and Britt Hume gives Williams are priceless. Stunned by his mendacity and illogic I think.

            Didn’t know that Williams son was a Republican. Kind of explains how Juan will sometimes get his knickers in a twist when the left calls Conservative AA “Uncle Toms’ or the like.

    Thanks for more details, Amy.
    For now, I’ll call the “he said/ she said” between Brennan and Senator Feinstein a draw. Brennan’s brusque manner has never appealed to me. I once thought Senator Feinstein was competent and dutifully seeking information. She seems to have developed a habit of pontificating before the cameras, but then going silent following push-back from this administration. Arlen Spector comes to mind.
    Frankly, both she and Brennan should have made the Benghazi investigation a priority, imo. Obama, Hillary, and Holder deserve investigation now, instead of the committees delving into Bush’s records.

He has the courage most of the establishment lack and the left is so used to bullying the right into complience they feel they must destroy any Republican who show a modicum of courage and/or integrity let alone competence.

      Remember that the leader of the free world who is also the leader of the Democrat Party evidently thought the United States had 57 states. One of their Representatives, the nutjob from Texas, thinks the Constitution has been around for 400 years. (And left us never forget the brilliant Hand Johnson who was concerned about Guam tipping over.)

      That’s been a major problem all along. They sent in the FBI 3 weeks after the fact, after the crime scene had been picked over, and confidential information removed. It was a completely bungled investigation from the very outset. Just ridiculous. I mean, really – somehow, reporters were able to get there almost immediately, but the FBI? Nope. CIA? Never. It is appalling.
