Filing Suit, Lawsuit Won, And More IRS Shenanigans *Open Thread*


Oh, so much going on with our Federal Government this week, isn’t there? From Obama’s seeming incompetence on foreign policy issues to the disastrous results of his lawless Immigration policies, to more revelations about the IRS, it has been SOME week.

Speaking of Obama’s lawlessness,, I mentioned in Comments yesterday that Speaker of the House, John Boehner, is filing a lawsuit against Obama on those very grounds. From The Hill:

[…] “On one matter after another during his presidency, President Obama has circumvented the Congress through executive action, creating his own laws and excusing himself from executing statutes he is sworn to enforce — at times even boasting about his willingness to do it, as if daring the America people to stop him,” Boehner wrote. “On matters ranging from healthcare and energy to foreign policy and education, President Obama has repeatedly run an end-around on the American people and their elected legislators, straining the boundaries of the solemn oath he took on Inauguration Day.”


“This is about defending the institution in which we serve,” he said. “You know, if you look back over the last 235 years of our history, there’s been a movement between the inherent powers of the executive branch and the inherent powers of the legislative branch.

“And what we’ve seen clearly over the last five years is an effort to erode the power of the legislative branch,” the Speaker continued. “I believe the president is not faithfully executing the laws of our country, and on behalf of the institution and the Constitution, standing up and fighting for this is in the best long-term interest of the Congress.”


“At various points in our history when the executive branch has attempted to claim for itself the ability to make law, the legislative branch has responded, and it is only through such responses that the balance of power envisioned by the Framers has been maintained,” Boehner wrote in his memo, without being more specific. I am sure it will come as a surprise to none of you that the Democrats essentially laughed this off, including Minority leader, Nancy Pelosi, who referred to Boehner’s move as “subterfuge.”

No doubt that is precisely what MSNBC host, Steve Kornacki, expected from George Washington law school professor, Jonathan Turley to do, too when asked about this lawsuit. And this is the response he got from The Daily Caller:

[…] “I think there is a case against the president for exceeding his authority,” he declared. “I happen to agree with the president on many of his priorities and policies, but as I testified in Congress I think he has crossed the constitutional line.”

“So where has he crossed it?” Kornacki pressed. “Like, what specific issue has he crossed it on?”

“Well, when the president went to Congress and said that he was going to go it alone, it obviously raises a concern,” Turley noted. “Because there’s no license for going it alone in our system.”

The law professor noted the unprecedented changes made to the Affordable Care Act — including the shift of nearly half a billion dollars to a purpose unspecified by Congress — as well as his deliberate disregard of existing law on immigration and the effective rewriting of other laws.

“While I happen to agree with him — I voted for him — I think this is a problem,” Turley asserted.

Oh, I bet THAT wiped the smug look off of Kornacki’s face, don’t you? If that didn’t do it, this might have:

[…] But this lawsuit could be very different. “So the first hurdle is going to be that standing issue, and it’s a high one. But it’s not necessarily insurmountable,” Turley explained. “The court has never truly closed the door on what’s called ‘legislative standing,’ particularly if it’s based on the institution — if the House of Representatives empowers the group that litigates this case.”

Put simply, Turley believes that a court may actually allow a challenge to a U.S. president as part of a legitimate showdown between the executive and legislative branches of the United States government. (Click here to read the rest.)

Of course, Obama isn’t the only one acting lawlessly in this government, but now we have PROOF that the IRS in fact DID act lawlessly. I know, we do already know this, but there are not one but two instances revealed just this week. The first is the monetary award to the National Organization for Marriage, $50,000 at the moment of your taxpaying dollars, for sharing private information with the Human Rights Campaign. If the HRC guy hadn’t taken the Fifth (a lot of that going around), the person responsible would have been held to account as well. In theory, that is.

According to Politico, the judge thought this was an isolated incidence, though considering everything that has been going on with the IRS, I cannot imagine how in the world the judge arrived at that conclusion. Oh, wait – federal judge. Never mind.

And I say that not just because of the targeting of the Tea Party and other affected groups, but because of the other bombshell that came out Wednesday. That would be that Lois Lerner was all set to audit US Senator Chuck Grassley based on an email invitation she received erroneously. Apparently, that was ALL it took for her to leap to “AUDIT!” of a high-ranking US Senator. Why? Because he is a Republican. The partisanship with which the IRS is conducting itself is just staggering, isn’t it? Sure will be interesting to see what else falls out from the emails the House Ways and Means Committee has received. One thing seems certain – Lois Lerner AND the IRS need to be held accountable for their actions, if not by Holder (yeah, right), than by the Congress. (I commend to you the very good commentary by Michael Gerson [of WaPo] I read today in the Post And Courier, “IRS Head Taxes The Public’s Credulity.”) It was written before the latest bombshell, which makes me wonder what Gerson would say NOW.)

      I don’t know why we should wait for anything. I would like for a special prosecutor to be named. Archibald Cox must be rolling in his grave. I’m sure that he thought Nixon would have been the last guy to attempt this type of control. Barry needs his ass handed to him on a platter…resign or be impeached.

        Especially since no matter how many times Obama is rebuked by the Supreme Court he still insists and intends on using his phone and his pen. And the equally corrupt Dems cheer him on.

        It is infuriating that Obama is doing his very DAMNDEST to break the law. Truly, I have never seen a president act like this, AND continue to get away with it. At least now, after the Supreme Court ruling yesterday, it seems he is finally being held accountable at least a little. Maybe that will empower others to stand up to him and for Boehner to go forward with suing him.

    This really pisses me off. They are bringing this TERRORIST here and reading him his RIGHTS. He is NOT a US citizen, and orchestrated an attack that KILLED US citizens. This is yet another reason why Holder should be impeached. Grrr. From Reuters:

      Many years ago the U.S. Supreme Court ruled that anyone – U.S. citizen or not – physically in the United Sates was entitled to due process protection. That is why most of the terrorists we captured are or were being held in Cuba. What we should all be upset about is that Obama is dealing with these cases as if they were criminal cases. Hence, we are treated to the scenes of these people being brought to our country, given Miranda warnings and provided free legal aid.

      I read a comment over at No Quarter yesterday from a guy who was in Lebanon at the time the Marine barracks were blown up and several hundred were killed. He was somewhat circumspect about what he was doing there but he sounded possibly like a CIA operative. His unapologetic bottom line is that we should have as our goal to kill as many terrorists as we can, legally, illegally, whatever, because that sure is their goal for us.

        I get that that is the ruling, and understand that to be the case. But that is why I think this terrorist should be taken to Gitmo for a military tribunal instead of bringing him into the US, treating this like a criminal case, an all the benefits he will then get.

        It is ridiculous that this Administration continues to bend over backward for people who are KILLING us simply because we are Americans. I simply cannot understand that mindset. Are we trying to prove that we are SO much more civilized than they are, or that if we treat them like they are just run-of-the-mill terrorists, they will stop trying to kill us? That is an absurd, naïve, infantile notion, if that is the case.

        Interesting comment from the guy who was in Lebanon. I agree, that is their goal, and I am sure we do kill terrorists illegally, but that said, Obama’s behavior notwithstanding, we ARE a nation of laws and if we are going to be killing someone, we better be doing it legally for OUR sake, not theirs. Know what I mean?
