Finally Some Comeuppance For The Partisan IRS? *Open Thread*


After the flagrant partisanship of the DOJ letting Lois Lerner off the hook on her contempt charge, and other failures to hold the IRS accountable for what has seemed like unbelievably clear instances of partisan targeting, it seemed like the IRS was going to get away with it all.

Not so fast! It seems that at least some judges actually care about doing the work of the country, and not the bidding of the President (disclaimer: that is my assumption, not yet proved – get those Lerner emails, and that might change). The Daily Signal has the story:

At almost the same time last week that the outgoing U.S. Attorney for the District of Columbia, Ronald Machen, gave Lois Lerner a get-out-of-jail free card over her contempt of Congress citation, the Justice Department and the Internal Revenue Service suffered a huge procedural loss in a court fight in Ohio.

In litigation filed in 2013 by conservative organizations targeted by Lerner and her colleagues at the IRS, a federal judge granted a motion to compel and ordered the IRS to produce the names of the 298 targeted organizations identified by the IRS for the Treasury Inspector General.

In 2013, NorCal Tea Party Patriots, the Faith and Freedom Coalition of Ohio, the Texas Public Policy Foundation and a number of other conservative organizations (ten in all), sued the IRS, the Treasury Department, Lois Lerner and other individual IRS employees.

They described themselves as organizations “comprised of individual citizens who have joined together to exercise their rights to freedom of speech and expression” and who “dissent from the policies or ideology of the” current administration. They claimed that, on the basis of their beliefs, they had been subjected “to delays and intrusive scrutiny during the tax-exempt status application process.” According to the ten plaintiffs, this violated the Privacy Act, the First and Fifth Amendments, and 26 U.S.C. §6103, a federal statute that protects the confidentiality of tax return information.

You may recall, and as this article states, that “True The Vote” had their case dismissed. Why? Because EVENTUALLY, after YEARS, the IRS finally granted their status. In other words, they got away with it against that organization. Nice. Not.

But not this time, as the Daily Signal article continues:

[…] On April 1, in what must have seemed a cruel April Fool’s joke to the Justice Department lawyers handling the case, Judge Dlott denied a protective order sought by Justice Department to prevent the IRS from being forced to turn over this information. She pointed out that Section 6103 has an exemption for tax information “directly related to an issue in” a judicial proceeding. Since the identity of all of the targeted organizations “is directly related to the issue of class certification in this federal court proceeding,” she granted the plaintiffs’ motion to compel. Specifically, she ordered to IRS to produce:

•All charts, lists, spreadsheets or indexes of groups that had their Applications for Tax Exemption selected or flagged by the IRS for heightened review based on an infamous BOLO (Be On the Look Out) edict issued by IRS officials;

•The document listing the 298 organizations that the IRS sent the Inspector General on June 11, 2012; and

•The document titled “Advocacy Case Tracking Sheet” that the IRS sent the Inspector General on the same date.

Dlott also ordered the IRS to either admit or deny the authenticity of an IRS document obtained by USA Today and publicized in a story on Sept. 18, 2013 that listed 162 groups that were flagged because of their “anti-Obama rhetoric, inflammatory language, and emotional statements.” […] (Click here to read the rest.)

I’d sure like to know the answer to that question, wouldn’t you? Did the IRS target these groups just because they weren’t a fan of #44?? For real? ‘Cause that ain’t right is all I have to say. We have this little clause in the Bill of Rights that allows us freedom of speech, assembly, oh and a few other things they may want to look into, so…Wassup with that, huh?

All I can say is, it is about damn time. It is about time this powerful agency of the government is being held to account at least a little bit. I hope Judge Dlott doesn’t let the IRS weasel out of complying with these orders, and that we can finally get some justice for these 298 organizations.

Oh, and while they are at it: WHAT IS IN THOSE EMAILS OF LERNER’S?? They have them now, so what do they SHOW? That is what I would like to know.

In the meantime, let’s hope this ruling will start to get us some answers. Hey, I can hope, right?

    I believe that even though the DOJ has let Lois Lerner off her saga is far from over.

    For one thing, she will be known as corrupt for as long as she lives. She will be loathed by millions of people for as long as she lives. She may have her salary and her retirement benefits but she will never again have a “good” name.

    That may not bother her since she seems to be a woman of little conscience or ethics or even decency, but it comes at a price.

      Yeah, unfortunately, for someone like Lerner who has demonstrated time and again her willingness to use her power against those who differ politically, her ethics are clearly lacking.

      But you are right – she will forever be known for what she did, though it sure does gripe me that she might get away with it all…

    Thomas Sowell’s “take” on the Iran “deal”. JMO but if this is what Obama wants to be his “legacy” he sets the bar very, very low. As in, “it ain’t much baby but it’s all mine”. Will we ever escape buffoonery and dishonesty in the White House? From either party?

    By abandoning virtually all its demands for serious restrictions on Iran’s nuclear bomb program, the Obama administration has apparently achieved the semblance of a preliminary introduction to the beginning of a tentative framework for a possible hope of an eventual agreement with Iran.

    But even this hazy “achievement” may vanish like a mirage. It takes two to agree — and Iran has already publicly disputed and even mocked what President Obama says is the nature of that framework.

      “Mirage” is a great word for what this “deal” is. The sad thing is, Obama’s followers will buy this hook, line, and sinker. And thanks to the attitude of this Administraion and the hate they have heaped on Israel, these same people won’t care if (when) something happens with Israel as a result of this stupid deal.

        I always like to point out when someone on a biased newspaper like the Post actually “reports” with some degree of honesty. After all I wouldn’t be pointing it out if it was their usual behavior.

    The only thing keeping Jon Stewart and Comedy Central relevant are carriage fees and a mainstream media that loves Stewart’s socialist ways. Ratings-wise, The Daily Show is a disaster. Last month only 1.25 million total viewers tuned in. In a country of more than 300 million, that is a statistical zero, and Stewart is considered a ratings success on Comedy Central.

    I had no idea that Comedy Central had such low ratings. As the article tells us, and many of us have known for a long time, that if our cable wasn’t “bundled” ratings losers would be gone from the market place. MSNBC would have gone long ago.

From the way they always glorify Stewart and his show, as well as how unbelievably well Stewart gets paid (another one of these gazillionaire limo Socialists), the impression was that his show was WILDLY successful. You are right – that is a pittance these days in terms of shows.

      That sure puts things in a whole new light, Marge.

        I have been screaming bloody murder ever since I read an article about how cable screws us by making us pay for channels we don’t want and never watch. I have been angry but not angry enough to give up my cable.

        After all where else would I do for reruns of my beloved NCIS and Grimm?. Not to mention reruns of the reruns of the reruns. And reruns of Law and Order are ALWAYS playing somewhere on cable if I get really desperate.

        Then there is always the Food Network for people cooking things no human being that cares anything about their health would eat. Paula Dean was always criticized for the unhealthy way she cooked but there are many, many more who do the same. That kind of eating landed me in surgery and resulted in a triple bypass. If I had only done what I knew was right about my diet years ago I could have save myself a lot of misery.

          No doubt we are paying for tons we don’t watch. There are a number of channels I NEVER turn to, but yet every month, we shell out the dough…

    In most media scandals, it’s unfair to paint with such a broad brush. When Stephen Glass concocted his fables at the New Republic, he went to antiheroic lengths to conceal his deceptions from his colleagues. Janet Cooke, who famously won a Pulitzer for her Washington Post series about an 8-year-old heroin addict, “Jimmy’s World,” lied to her editors.

    That’s not the case with Rolling Stone’s publication of “A Rape on Campus,” the story of the brutal gang rape of a student named “Jackie” at the University of Virginia that turned out to be false. Its failure was a group effort, from editor-in-chief Jann Wenner on down.
