Same Facts, Different Conclusions, By Baltimore Police Task Force *Open Thread*


I am sure this will come as a shock to NO ONE who has been following the outcome of Prosecutor Marilyn Mosby’s charges of six police officers in Baltimore. That she had gotten the results of the investigation the day before she made her big “I’m On National News!” speech, and the autopsy report the day OF her political proclamation, speaks volumes about her and her mindset. Of course, her political speech, rather than deliberative judicial speech, did that too, but let’s not quibble. Ahem.

Just in case you need a reminder, if this isn’t seared into your brains by the sheer scope and range of Mosby’s claims and her making this about the rioters not the law, here is what Mosby said. From Christian Science Monitor:

[…] “To the people of Baltimore and demonstrators across America, I heard your call for ‘No Justice, No peace,'” she said. “Your peace is sincerely needed as I work to deliver justice on behalf of this young man.” […]

Uh, I am no attorney, but plenty of those who are, including Alan Dershowitz, criticized Mosby for trying to stop the riots by throwing everything she could think of at these six police officers while listening to the demonstrators and not the EVIDENCE. There is no room for subverting the actual findings to APPEASE those who are out of control and demanding results that do not fit the information at hand.

Given that, the actual evidence and information, it seems the Baltimore Police Task Force came to a slightly totally different conclusion than Ms. Mosby. From the Daily Caller:

[…] Baltimore police’s task force believed that manslaughter would be the highest charge any of the six officers charged would face, CNN reported.

Instead, Baltimore City state’s attorney Marilyn Mosby is charging Caesar Goodson Jr., the officer who transported Gray in a police van, with second-degree depraved-heart murder, manslaughter, involuntary manslaughter, second-degree assault and misconduct.

Homicide investigators also believed that the medical examiner conducting Gray’s autopsy was set to determine that the cause of death was something less than homicide. They were surprised when Mosby announced Friday that Gray’s death was ruled a homicide.

I am sure they were surprised by this, especially since SA Mosby seems reluctant to allow ANY of the findings to be released. I wonder why that is? Okay, not really – I am pretty sure why that is. But that isn’t the only issue with the level of charges Mosby filed:

CNN’s report comes a day after Edward Nero, one of the officers who helped arrest Gray, filed a motion in Baltimore District Court to force Mosby to turn over the knife found on Gray during his April 12 arrest.

Mosby said on Friday that Gray’s arrest was illegal, in part, because the knife was not a switch blade and therefore not illegal in Maryland.

But in the motion, Nero claims that the “spring-assisted” knife was illegal within Baltimore city limits, which has stricter laws than the rest of the state. (RELATED: One Of The Cops Charged In Freddie Gray Case Insists Arrest Was Legal)

Oh, those pesky little distinctions of what is legal inside the city and outside. Seems to me that maybe someone’s rush to quell the rioters and appease them may have led her to miss just a few things (that was sarcasm, buy the way).

But wait – there is more, and this is a goody:

[…] One of Mosby’s top investigators could also cause problems for the state’s case.

Avon Mackel was demoted from his position as a high-ranking Baltimore police officer in 2009 for failing to properly investigate a robbery case two officers failed to report. Four months after the demotion, a SWAT unit was dispatched to Mackel’s home. Officers found him drunk and with a gun, and he was tased.

According to CNN, the officers’ defense attorneys will likely home in on Mackel’s demotion, claiming that he is biased against his former employer.

Mosby declined to discuss the case but issued a statement.

“While the evidence we have obtained through our independent investigation does substantiate the elements of the charges filed, I refuse to litigate this case through the media,” Mosby told CNN. […] (Click here to read the rest.)

Why in the hell would the State use an investigator with this history in the FIRST place> I mean, really – that is just stupid. It is stupid that they didn’t find someone who had a CLEAN record, and was above reproach. Maybe they couldn’t FIND someone like that in MD, but geez – they coulda gotten someone from SOMEWHERE that did not have this kind of track record.

But for Mosby to say she wasn’t going to try this in the Press is hilarious. OHMYGOSH – that is funny. Good one, Mosby!! She seems all too willing to get herself out in front of the cameras, so I am finding that hard to believe.

I am also finding it hard to believe that the black Mayor of a predominantly black city with a black Police Commissioner, a black States Attorney, and the predominantly black City Council, has asked the DOJ to come in and investigate her police force for racism. Wow.

No wonder Police Officers have started a campaign of #BlueLivesMatter. Who can blame them? As Greg Gutfeld said on “The Five” Wednesday afternoon, when a radical Muslim does something, people try to claim he was just a bad apple. When something bad happens involving a police officer, the entire force is painted with that brush (or words to that effect). That does seem to be the case, doesn’t it? Good for these Officers and their families for making clear that ALL lives matter, including theirs. This one says it all:

Blue Lives

Indeed – Officer Moore’s life does matter, at least tome.

Naturally, Liberals got their panties in a wad that the Police had the AUDACITY to say their lives mattered, too, but that is par for the course, it seems. Wonder who they plan to call when they get in trouble? Yeah, we all know who, and they will be damn glad when the folks in Blue show up at their door.

At least that’s what I think. How about you?

    How dare the police push back against the scurrilous lies being told about them? How dare they think that their lives matter? WTF is the matter with liberals? They can’t have ALL been dropped on their heads as babies can they?

    Marilyn Mosby’s case against the two arresting officers rests upon an “illegal” arrest. She says the knife that Freddie Gray was carrying was legal. But the police task force examined it and said the officers were indeed correct, the knife was spring-assisted and therefore prohibited.

    It’s Mosby who made the “illegal” arrest, and could be charged under her own theory of “false imprisonment.” And sued to boot, since she forfeited her immunity from civil action by doing the charging herself.

    We continue looking through the direct action filing, the probable cause to arrest determination, as outlined in Mosby’s own words – and comparing her words to the factual evidence she is seeking to hide. What we are finding is jaw dropping.

    In her “rush to judgment did Marilyn Mosby not “know” these facts or did she just ignore them? Either way, her actions become less excusable all the time. She isn’t “law enforcement”, she a political activist with a racist agenda.

      Sorry for the delay in responding to all of these great comments – had to go to the dentist (no biggie – permanent crown and regular cleaning, but torrential downpours which made driving difficult, especially for my achy breaky knee).

      Anyway – yes – it is amazing how little time Mosby took to review the evidence. I believe it was Sheriff Clarke who spoke abt that from the get-go, and how she could not POSSIBLY have reviewed it all.

      I could not BELIEVE how they are spending our tax dollars. This is just getting WAY out of hand. Most Dems I bet have NO idea the extent of the crap Obama and his minions are doing in this country. I have to believe that (to answer your question, Marge, abt them being dropped on their heads). I think most of them are just too busy working and raising families to know all of the ins and outs of this insanity. Gotta hope…

      As I listen to Geraldo spewing his blame of Geller right this minute, this is most appropriate.

      He said she wouldn’t get this air time if she was going after Jews, and no one targets Jews like this. I am thinking he hasn’t been paying attention to what our students are being taught on college campuses, or following the Divestment from Israel movement.

      But yeah – I love how, even as he calls terrorists savages, he essentially is arguing that she incited them by having a CARTOON contest. Yep – she is a horrible human being and we can’t insult Sharia abiding Muslims…

      I might add, when people like Geraldo try to equate Geller saying these things abt, say, Jews, he misses the mark: Jews, and other religious groups, do NOT have terror cells in our country, nor are they trying to kill us, obliterate us, or force us to live under their laws. Radical Islamists want ALL those things. Big, big difference…(And of course, not all Muslims support this – by we cannot deny that there are some who do.)

      It is ironic, though, as Brian Kilmeade pointed out this morning – the last time, they DID look at eevry single thing they did and ignored Obama’s past. This time, they ignore not just what she has done in the past, but what she says now.
