Jerusalem Has Become No Man’s Land Courtesy Of Obama And SCOTUS *Open Thread*

While we have been distracted by the Bruce/Caitlyn Jenner and McKinney Girls and Boys Gone Wild Pool Party in formerly quiet, peaceful, McKinney, Texas, there have been some other major issues going on in the country. One in particular also affects a (former?) ally, Israel, in a decision by the Supreme Court of the United States. That country would be Israel, specifically Jerusalem.

And just what is that, you might ask? Well, the SCOTUS has decided, in its “wisdom,” to side with President Obama in claiming that Jerusalem – JERUSALEM – does not an Israeli make.

No, really. I am serious. From Legal Insurrection:

The Supreme Court decided the much-anticipated Zivotofsky case, involving a congressional law which permitted American citizens born in Jerusalem to choose to list “Israel” as their place of birth, rather than just “Jerusalem,” as the State Department mandated. (Full Opinion here.)

Needless to say, the case had enormous political implications, even if the legal issue itself was not particularly political. The Executive Branch refuses to recognize Jerusalem as the capital of Israel, or even though Israel has declared Jerusalem to be its capital both when it was divided prior to 1967, and after it was reunited in 1967. Worse still, for passport purposes it does not even recognize Jerusalem as part of Israel at all.

The political gloss is that the Executive Branch claims the issue should be subject to negotiations, but the reality is that the State Department fears backlash from the Palestinians and Israel-hating nations (i.e., most of the United Nations) should it side with Israel’s claim to Jerusalem as its capital.

Congress, on the other hand, is in sync with American domestic public opinion, which is overwhelmingly pro-Israel, so in 2002 Congress passed a law to force the State Department’s hand on the issue.

The next year, Menachem B. Zivotofsky was born and his parents wanted his passport to record Israel as his place of birth.

No way, said the State Department, leading to litigation culminating in the current decision holding that the law violated the separation of powers, which vests the ability to recognize foreign sovereigns only in the Executive Branch, the Court held. […] (Click here to read the rest.)

Isn’t that just astonishing?? If you have ever read the Bible, Old or New Testaments, Jerusalem is there. And it is there as a major center in the lives of Jews. Yet Obama, and now affirmed by SCOTUS, have declared that thousands of years of history are no match for his political agenda. Hence, Jerusalem cannot possibly be the capital of Israel.

As you might imagine, this is big news to those Israelis who are from, and live in, Jerusalem. Jordana from the Jerusalem Post, is one such person, and had this to say about the SCOTUS decision backing of Ruler of the World Obama:

Yesterday I was informed that I am not a resident of Israel, as I previously believed.Six Supreme Court Justices from the United States informed me that, as far as they were concerned, I am a resident of Jerusalem, Full Stop. Or Jerusalem, Earth. What has been universally regarded as the capital of the Jewish homeland for 67 (and over 3,000) years is suddenly in no man’s land, a casualty of those who would rather see this city as part of a political agenda, instead of a home to thousands of Israelis.

And so Jerusalem, which is the home of the Knesset and the Supreme Court, and the city mentioned in Torah almost 700 times and never once in the Koran, is apparently not to be considered the capital of the Jewish State. Because they say so. And so, please G-d, when I have children who will hopefully be born in some hospital in undisputed and US-sanctioned West Jerusalem, and I apply for an American passport (because I still love and appreciate the country of my birth), those children with be from “Jerusalem, the Universe.” “Jerusalem, Nowhere.” “Jerusalem, We are too scared of World Opinion to be honest and say it’s Israel.”

To me, this is a real tragedy. It has negated what our ancestors died for, in Jewish history and in the history of this State. And if I’m honest, it’s an act of defiance against our own self-determination. We are being told that the United States is denying our right to choose our own capital. The cabinet is ostensibly saying that, so as not to offend the minority, you must gravely insult the majority. This whole debacle does nothing but weaken the Jewish claim to this city, and perhaps that is the point.

It is a real tragedy to me, too. I am stunned at this decision from the Supreme Court. It is bad enough that Obama wanted to make this false distinction to continue his kowtowing and appeasement of Muslims. But for the SCOTUS to SUPPORT it is just mind boggling.

Jordana in Jerusalem” continued her comments on this declaration from the USA:

Perhaps there is an unsaid goal that if people say Jerusalem isn’t really part of Israel, it will make it so. And the army of anti-Zionists and anti-Semites worldwide is jubilant at this public slight. Just looking at the comments sections of the various articles about this case will give you a glimpse into the international damage this is causing to a people that suffers one assault after another.

Well I, for one, refuse to be told that the capital city of Israel is not actually located in Israel. I refuse to believe that due to political correctness and a fear of condemnation from the Arab World (and- gasp! Europe), children born in Jerusalem have no country to call their own. And I pray for the day when the State Department and the president and the US Supreme Court agree with me and change this ridiculous ruling. But until that time, I remain a proud resident of Jerusalem, eternal capital city of the State of Israel. (Click here to read the rest.)

I have no doubt she is not the only one who feels this way. Hell, I feel this way. It is not just political correctness, but an appeasement to a bunch of terrorist-aligned countries and groups, like Hamas. I find that to be an ABHORRENT position taken by this country.     What possible right does the Supreme Court of the United States have to decide this issue?

    Every day there is some new outrage from our government. I feel battered by the constant barrage of attacks on freedom and decency by the liberals and the cowardly Republicans. Our Supreme Court isn’t and hasn’t been about the law for a very long time. It is all about politics. And there can be no justice for anyone when that happens.

    I am not surprised to be disgusted with the females members of the court since they are never about justice or law and always about the liberal agenda. Not surprised much by Breyer and Kennedy since they waffle back and forth and care little about the law.

    Thomas surprised me. And disappointed me.

      Excellent question, Marge. I think it is how the suit came up to them, and enforcing the President’s Executive Authority to decide who is and is not a country, apparently. It is unbelievably disturbing to me.

      And you are right, especially abt the women on the court. Some of the more recent additions just boggled the mind, especially when you looked at some of the things they said, and their lack of judicial experience (talking abt you, Sotomayor, who I do not even think is that bright from things she has said). It is stunning.

      It used to be abt the law and the Constitution. Now it is abt going whichever way the wind is blowing. UGH.

    I don’t know if any of you caught Carly Fiorina on “Special Report” panel last night. I did and I thought she was beyond impressive. If we are going to have a woman in the White House at least it would be nice to have a really smart one like Fiorina.
